These terms are in effect and govern your CarteCasa membership, including the 30-day free trial and the $99/month automatically renewing subscription that follows it unless you cancel. They are not legal, financial, tax, mortgage, or real-estate brokerage advice. CarteCasa is a membership platform that connects you with participating licensed agents — it is not a real estate brokerage.
Terms of Service
The terms that govern your use of the CarteCasa platform and membership.
1. Acceptance of these terms
These Terms of Service ("Terms") are a contract between you and CarteCasa LLC ("CarteCasa," "we," "us"). By creating an account, starting a membership, or using the platform, you agree to these Terms, the Membership Agreement, and the Privacy Policy. If you do not agree, do not use the platform.
2. The service we provide
CarteCasa is a membership platform that connects members with participating licensed real estate professionals and coordinates showing requests on a concierge basis. CarteCasa is not a real estate brokerage and does not provide real estate brokerage, agency, or representation. CarteCasa does not provide legal, financial, tax, mortgage, inspection, appraisal, or real-estate brokerage advice. Licensed real estate services are provided by participating agents and their sponsoring brokerages under separate written agreements.
3. Eligibility and availability
You must be at least 18 years old to use CarteCasa. CarteCasa is currently available for Illinois homebuyers and Illinois properties; it is not yet available in other states.
4. Membership, free trial, and automatic renewal
CarteCasa membership begins with a 30-day free trial. You provide a payment method through our payment processor (Stripe) when you start the trial. We do not charge you during the trial. Unless you cancel before the trial ends, your membership automatically converts to a paid subscription of $99.00 per month (USD): your payment method is charged $99.00 on the day the trial ends and on the same day each month after that, until you cancel. The $99/month membership is the only charge CarteCasa makes. Your membership billing does not change based on whether or when you engage a participating agent for representation, and CarteCasa does not charge any purchase, closing, platform, referral, or transaction fee. Showing fees and any buyer-agent representation fee are separate, agent-side fees handled outside CarteCasa — for example, a flat showing fee and a flat fee of approximately $3,000 for buyer-agent representation — paid to the participating agent or the agent's sponsoring or managing brokerage, not to CarteCasa, which does not collect, receive, process, or escrow them. By starting the trial you give your express consent to these recurring monthly charges after the trial unless you cancel. You may cancel at any time through your billing portal; cancellation stops future charges. The detailed billing, cancellation, and refund terms are in the Membership Agreement and control over this summary if they differ.
5. Acceptable use
You agree not to misuse the platform: no unlawful, fraudulent, infringing, or harassing activity; no attempts to disrupt or reverse-engineer the service; and no use of the platform to provide real estate services unless you are separately licensed and engaged to do so. We may suspend or terminate accounts that violate these Terms.
6. Third-party professionals and no agency
Participating agents and brokerages are independent third parties. CarteCasa does not employ, supervise, control, or direct their licensed work and is not responsible for their acts, omissions, advice, pricing, availability, or the outcome of any real estate transaction. CarteCasa is not your agent and owes you no fiduciary duty. Any relationship for licensed services is between you and the participating agent or brokerage under a separate written buyer-broker agreement and any other disclosures required by that brokerage or applicable law.
7. Written buyer-broker agreement before touring
Before any in-person touring or licensed real estate service occurs, the participating agent or the agent's sponsoring brokerage must provide, and you must execute, any required written buyer-broker agreement and related disclosures directly with that agent or brokerage. CarteCasa membership does not replace that agreement and does not authorize CarteCasa to act as your broker or agent.
8. No guarantees
The platform is provided on an "as is" and "as available" basis. CarteCasa does not guarantee that any showing, tour, offer, credit, saving, or transaction outcome will occur, and does not promise savings, seller credits, reimbursement, or offer acceptance. To the fullest extent permitted by law, CarteCasa disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, CarteCasa's total liability arising out of or relating to the platform will not exceed the membership fees you paid to CarteCasa in the three (3) months before the event giving rise to the claim. CarteCasa is not liable for indirect, incidental, special, consequential, or punitive damages, or for the conduct of participating agents or brokerages.
10. Governing law and venue
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the platform will be handled in the state or federal courts located in Illinois, unless applicable law requires otherwise.
11. Changes to these terms
CarteCasa may update these Terms from time to time. We will post changes here and update the effective date, and for material changes — including any change to the membership price or renewal terms — we will provide notice by email or in the product before the change takes effect. Continued use after an update takes effect means you accept the updated Terms.
